EFF Austin is a non-profit corporation organized for charitable, education and scientific purposes. While EFF Austin and its members use electronic and wire communications, applications and services, EFF Austin is not a provider of either wire or electronic communications service.

This Policy pertains to the information requested by EFF Austin about and from its members. This information may take paper and/or electronic form, and it may appear, among other places, on web sites controlled by EFF Austin, within computer applications or storage devices or on paper and it may be collected or stored within the organization, by its officers or at various events sponsored by, or attended by, EFF Austin. The list of data elements maintained for each member may be requested by any member or any person considering membership. Current data held for any member may be requested for viewing or updating by that member at any time, and will be responded to by the organization in a reasonable time.

The notice obligations of this Policy require that all members provide to the organization, and keep current, a working email address. Failure by any member to do so waives the organization’s duty to notify that member as described in this Policy. The Policy may evolve as the operations and communications of the organization change, and changes to this Policy will be posted on the web sites and at the events mentioned previously, and provided to members via email.

EFF Austin takes this Privacy Policy, and the general consideration of privacy very seriously. Any questions or complaints about the Policy, or about its execution, will be forwarded to all Directors by sending an email message to:

EFF Austin will not share, publish, provide access to, or otherwise disclose to any person or entity, other than the Directors of the organization, the names, email addresses, or other personal identifying information (PII) of any kind pertaining to its members (the “Member Information”), with the following exceptions and qualifications:

  • Where member names are related to newsworthy events, functions, and work projects described or reported on the web sites or printed publications, only member names will be identified, but no contact information. Members may request that their names not be shown at all in such locations and circumstances. NOTE: This is an OPT-OUT provision for member action.
  • For instances where a member, volunteer, officer or director of the organization requests contact from other members or the public, via appearance of a notice or request on an EFF Austin web site or printed publication, said contact will convey written permission for such disclosure of contact information, to the President of the organization, prior to posting or publication. Such permission may be conveyed by letter, email, FAX, handwritten document, or other authoritative means. NOTE: This is an OPT-IN provision for member action.
  • Where various electronic applications and services are used to communicate among the members (such as email list servers, blogrolls, etc), there will be no function for displaying a list of organization members or users of such applications and service except as necessary to allow the members or users to directly communicate. Use of such an application or service by the members or users constitutes consent for their electronic addressing information to be conveyed as needed in order for the service or application to function.

    Requests for contact or other Member Information pertaining to specific members made to the volunteers, officers, and Directors by any means (in-person, telephone, email, etc) will be directed to the member in question for response. Requests made by any means for lists or extracts of Member Information, in hardcopy or electronic form, from any person or entity (including members) will be denied. Exceptional circumstances will be submitted to the Directors for consideration.

    In the event EFF Austin receives a subpoena or other judicial order to produce Member Information, or any part thereof, effected members will be notified as soon as possible if the subpoena or order does not expressly prohibit such notice. EFF Austin disclaims any obligation or duty to resist, object, or bring any action with respect to such an order.

    Future Consideration – It is anticipated that EFF Austin may develop alliances with another organizations, or become involved in projects, where an exchange or disclosure of information seems to be within the spirit and intent of the purpose of the organization. In such circumstances, exact terms of disclosure will be developed by the Directors and all members will be provided ten (10) days notice, via email, before the disclosure or exchange of Member Information, during which time to request that their membership be cancelled and their information be removed from EFF Austin records.

    In the event EFF Austin, or any of its members, volunteers, officers or directors, fail to execute and comply with this policy or any of its provisions, best efforts will be made to correct the error and rectify the situation. THESE EFFORTS SHALL BE THE SOLE OBLIGATION AND DUTY OF THE ORGANIZATION AND ITS MEMBERS, VOLUNTEERS, OFFICERS OR DIRECTORS. NEITHER EFF AUSTIN, NOR ANY OF ITS MEMBERS, VOLUNTEERS, OFFICERS OR DIRECTORS SHALL BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THIS POLICY OR ITS EXECUTION IN ANY MANNER, OR FROM ANY OTHER ACTION OR INACTION, OR IN TORT, WHETHER OR NOT SAID ORGANIZATION OR INDIVIDUALS HAVE BEEN MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES.
